Terms of Service
1. The deal
Spiky is an online party game. The core game is free to play. You may also purchase a Gold Cactus subscription, which unlocks larger rooms and premium category packs (see Section 7). By using the site or subscribing, you agree to these terms. If you don't agree, don't use the site.
2. Be decent
You are responsible for the nicknames, answers, and bluffs you submit. Don't use Spiky to harass, threaten, defame, or harm anyone, don't submit illegal or hateful content, and don't impersonate others. To keep the game friendly, we automatically filter slurs and hard profanity, and other players can report content they find offensive. We may hide content, remove rooms, and warn, suspend, or ban accounts or devices that break these rules.
3. No warranty
Spiky is provided “as is” without warranty of any kind. We don't guarantee uninterrupted service, error-free games, or that questions will always be accurate. Sometimes servers go down. Sometimes a question is wrong — use the in-game report button if you spot one.
4. Limitation of liability
To the fullest extent allowed by law, the operator of Spiky is not liable for indirect, incidental, or consequential damages arising from your use of the site. The total liability for any claim related to Spiky is limited to the amount you paid us in the twelve months preceding the claim.
5. Intellectual property
All Spiky branding, artwork, copy, original questions, and source code are © 2026 Spiky. All rights reserved. You may not copy, redistribute, or build derivative products from Spiky's assets without written permission.
User-submitted content (your nicknames, answers, bluffs, feedback) remains yours, but you grant Spiky a non-exclusive licence to store and display it inside the game and in moderation tools.
6. Accounts
Anonymous play does not require an account. The anonymous device ID stored in your browser is not an account; clearing your site data resets it and we cannot recover or transfer it for you.
Signing in with Google or Apple creates a real account, used to manage your Gold Cactus subscription and carry your entitlement between devices. You may sign out at any time, or delete the account from your account page (or by emailing us). Don't share your sign-in credentials with anyone.
7. Subscriptions and payments
Gold Cactus is an optional, recurring subscription. Pricing, billing period, and what's included are shown before you confirm purchase. Who processes the payment — and acts as merchant of record — depends on where you subscribe:
- Web — processed by Dodo Payments, who act as the merchant of record. You agree to Dodo Payments' terms when paying.
- Android app — processed by Google Play Billing and governed by Google Play's terms of service.
- iOS app — processed by Apple as an in-app purchase and governed by Apple's Media Services Terms and Conditions.
The following terms apply to every Gold Cactus subscription:
- Auto-renewal. Your subscription automatically renews at the end of each billing period (monthly or yearly, depending on the plan you chose) until you cancel. On the iOS and Android apps, renewal is charged to your Apple or Google account within 24 hours before the period ends.
- Cancellation. Cancellation stops future renewals; you keep access to Gold Cactus features through the end of the current paid period. Where you cancel depends on how you subscribed:
- Web — from your account page, which opens the Dodo Payments customer portal.
- iOS — in the iOS Settings app: tap your name → Subscriptions → Spiky. Apple does not let us cancel an App Store subscription on your behalf.
- Android — in the Google Play Store: Menu → Subscriptions → Spiky.
- Refunds. Refunds for purchases made in the iOS or Android apps are handled entirely by Apple or Google under their own policies — we cannot issue them (for iOS, request a refund at reportaproblem.apple.com). For web purchases, payments are final once your subscription is active; we do not refund unused time, change of mind, or lack of use, though we may review accidental charges by email at our sole discretion.
- Promotional pricing. Limited-time promotional prices (such as a discounted first period) apply only as described at the point of purchase. Subsequent renewals charge at the standard advertised price.
- Failed payments. If a renewal payment fails, the relevant processor (Dodo Payments, Google, or Apple) will retry per its default schedule. If retries continue to fail, your Gold Cactus features may be revoked until payment succeeds.
- Price changes. We may change prices, plan names, or included features. Any change to the price you pay on renewal will be communicated before it takes effect (by email, or by the app store where required), and you can cancel before the new price applies.
- Taxes. Prices may exclude applicable taxes; the relevant merchant of record (Dodo Payments, Google, or Apple) adds them at checkout where required.
8. Termination
We may suspend access to the site, individual rooms, or specific users at our discretion — for example, if someone is abusing the game or breaking these terms. We may also cancel a subscription for the same reasons. For web subscriptions we will refund the unused portion of the current paid period; for App Store and Google Play subscriptions, any refund is subject to Apple's or Google's refund policy, as we cannot issue those refunds directly.
9. Changes
We may update these terms. The date at the top reflects the latest version. Continued use of Spiky after changes means you accept them.
